These Terms and Conditions ("Terms") govern your access to and use of the website, mobile application, and services of the OCHelpNow program, operated by Orange County Chinese Community Service, a California nonprofit public benefit corporation ("OCCCS," "we," "us," or "our"), available at www.ochelpnow.com (the "Service"). By creating an account, checking the box indicating your agreement, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
PLEASE NOTE: THESE TERMS AFFECT YOUR LEGAL RIGHTS. THEY DESCRIBE THE LIMITED ROLE OCCCS PLAYS, DISCLAIM WARRANTIES, LIMIT OUR LIABILITY, REQUIRE YOU TO INDEMNIFY US, INCLUDE A RELEASE OF CLAIMS AND A WAIVER OF CLASS ACTIONS AND JURY TRIAL, AND REQUIRE YOU TO CONTACT US BEFORE FILING A CLAIM. OCHELPNOW IS NOT A MEDICAL PROVIDER AND IS NOT AN EMERGENCY SERVICE. IF YOU ARE EXPERIENCING A MEDICAL, SAFETY, OR OTHER EMERGENCY, CALL 911 IMMEDIATELY.
1. What OCHelpNow Is
OCHelpNow is a free community program in Orange County, California. Residents post requests for everyday practical tasks, and community volunteers choose which requests to accept. There is no charge for the help and volunteers are not paid.
Volunteers may offer: errands and shopping; minor home repair and maintenance; furniture assembly and installation; yard cleanup; moving assistance; animal and pet help; interpreting and language accompaniment; tutoring and technology instruction; in-home technology setup; ride-booking help (helping you book and meet a licensed ride service — volunteers never drive you themselves); organizing and decluttering; form and paperwork help; and check-in visits.
OCHelpNow works as an open request board. When you post a request, it is shown to volunteers who have signed up for that category and area. Interested volunteers respond, and you choose who you would like to come. OCCCS does not perform the help, does not assign or recommend volunteers, does not rank or score responses, and does not participate in your choice.
In these Terms, "Requester" means an adult who asks for help through the Service; "Volunteer" means a community member who offers help through the Service without payment; and "User" means anyone who uses the Service, including a family member or authorized representative acting for a Requester.
2. What OCHelpNow Is Not
OCHelpNow and OCCCS are not:
a healthcare provider, home health agency, home care organization, personal care provider, or provider of medical, nursing, or therapeutic services;
an emergency service. If you are experiencing a medical, safety, or other emergency, call 911 immediately;
an employer or agent of any Volunteer, and Volunteers are not employees, contractors, agents, or representatives of OCCCS;
a transportation provider, delivery or courier service, cleaning or janitorial service, or provider of in-home care, companionship, or personal care;
a licensed care facility, conservator, fiduciary, or financial services provider; or
a guarantor of the availability, quality, safety, timeliness, or outcome of any help provided by a Volunteer.
3. What Cannot Be Requested Through OCHelpNow
The Service is limited to non-medical, non-personal-care help. Volunteers are prohibited from doing the following, and Users must not ask for them:
Driving a Requester anywhere. A Requester must never be a passenger in a Volunteer’s vehicle. A Volunteer may help you book a licensed ride service instead;
Standalone delivery or courier service. Items obtained during an errand come back to you as part of that errand;
Housecleaning, janitorial, or laundry services;
In-home care, supervision, or in-home meal preparation;
Hands-on personal care, including help with bathing, toileting, incontinence care, dressing, grooming, feeding, transferring, or walking;
Any medical, nursing, or therapeutic task, including wound care, injections, blood glucose testing, catheter or ostomy care, or operating medical equipment;
Administering, preparing, splitting, or handling medication. A Volunteer may pick up a prescription that has already been filled, but may not manage or give it;
Handling or holding your bank cards, PINs, passwords, or banking credentials, or making purchases other than as Section 9 allows;
Serving as an agent under a power of attorney, a conservator, a trustee, a joint account holder, an authorized signer, or a beneficiary of any account, insurance policy, will, or trust;
Witnessing or notarizing a will, trust, deed, power of attorney, or advance health care directive;
Accepting gifts, loans, tips, or bequests from you, or approaching you for any outside business, investment, religious, or political purpose;
Giving legal, financial, tax, insurance, immigration, or medical advice; or
Continuing a service relationship with you outside the program in order to get around these Terms or the Volunteer Agreement.
If you need help of a kind listed above, please contact an appropriately licensed provider — for example, a licensed transportation service, a cleaning company, or a licensed home care organization or home health agency. We can point you to community resources on request.
4. Eligibility and Authority to Use
You must be at least 18 years old to create an account or agree to these Terms. The Service is not directed to, and may not be used by, anyone under 18.
If you are using the Service on behalf of an older adult — as a family member, caregiver, guardian, conservator, or holder of a power of attorney — you represent that you have the legal authority to do so and to agree to these Terms on that person’s behalf. You accept these Terms for yourself and for the person you assist, and you agree to keep them informed about the help being arranged to the extent they wish to be involved. We may ask for documentation confirming your authority.
5. Accounts and Registration
To use certain features you may need an account. Provide accurate, current information and keep it updated. You are responsible for keeping your credentials confidential and for activity under your account. Accounts are personal and may not be sold, transferred, or shared. Tell us promptly at info@occcs.org about any unauthorized use.
6. Volunteers: Status, Screening, and Requirements
6.1 Volunteers Are Not Employees or Agents of OCCCS
Volunteers take part in OCHelpNow without payment, freely and for community reasons. A Volunteer is not an employee, independent contractor, agent, partner, or joint venturer of OCCCS. OCCCS does not supervise, direct, or control how a Volunteer carries out a visit and does not set a Volunteer’s hours. Nothing in these Terms creates an employment, agency, partnership, or franchise relationship.
6.2 Volunteer Agreement
Every Volunteer must separately review and agree to the OCHelpNow Volunteer Agreement, which covers conduct, screening, driving, confidentiality, money, and ending participation. Where these Terms and the Volunteer Agreement conflict as to a Volunteer’s participation, the Volunteer Agreement controls.
6.3 Screening Is Limited and Is Not a Guarantee
Volunteers complete an application, and once an application is approved, a background check is carried out by an outside screening agency with the Volunteer’s separate written authorization. Any screening is limited in scope and in the jurisdictions and time periods it covers. It is not a guarantee of any Volunteer’s character, honesty, qualifications, fitness, or safety, does not reveal all relevant history, and must not be relied on as an assurance of safety. Use your own judgment about who you invite into your home.
6.4 Driving and Insurance
Help arranged through the Service never includes driving a Requester. A Volunteer may drive themselves to a visit or carry tools, supplies, or items obtained on an errand, and must in that case hold a valid California driver’s license, carry automobile insurance meeting at least California’s minimum limits, and drive a registered, roadworthy vehicle.
OCCCS DOES NOT CARRY AUTOMOBILE, GENERAL LIABILITY, WORKERS’ COMPENSATION, OR ACCIDENT INSURANCE COVERING VOLUNTEERS, REQUESTERS, OR THEIR PROPERTY. ANY LOSS, INJURY, OR DAMAGE ARISING FROM HELP ARRANGED THROUGH THE SERVICE IS A MATTER BETWEEN THE PEOPLE INVOLVED AND THEIR OWN INSURERS. PLEASE TAKE THIS INTO ACCOUNT WHEN DECIDING WHETHER AND HOW TO USE THE SERVICE.
7. Your Responsibility and Due Diligence
You are responsible for using your own judgment before accepting help from, or offering help to, anyone through the Service. This includes confirming that an arrangement meets your needs and using reasonable caution, particularly where a Volunteer will be in your home or around your property, finances, or personal information.
We encourage Requesters and their families to meet a Volunteer at the door or with another person present on a first visit; to secure valuables, medications, financial documents, and identification; never to share account numbers, PINs, passwords, or Social Security numbers with a Volunteer; and to tell us promptly if anything feels wrong.
8. Conduct
You agree not to use the Service to:
violate any applicable law or regulation;
harass, abuse, neglect, exploit, defraud, isolate, or endanger any person, including any older or dependent adult;
impersonate anyone or misrepresent your identity, qualifications, licensure, or affiliation;
post or send false, misleading, discriminatory, harmful, obscene, threatening, defamatory, or infringing content;
approach users for unrelated commercial, investment, religious, or political purposes;
collect, scrape, or store information about other users except as needed to arrange help through the Service;
arrange help off-platform in order to get around these Terms or applicable safeguards; or
interfere with, disrupt, probe, or compromise the security of the Service.
We may investigate and may suspend or end access for anyone who, in our judgment, violates these Terms or poses a risk to others, without prior notice where we believe there is a risk to someone’s safety.
9. No Fees; Out-of-Pocket Costs
OCHelpNow is free. OCCCS does not charge you for the help, does not take a fee or commission, and does not process payments. Volunteers are unpaid and must never accept money, tips, gift cards, or valuables from you or your family, for any reason. If a Volunteer asks you for money, please tell us at info@occcs.org.
You remain responsible for the cost of anything bought on your behalf — groceries, a prescription copay, parking, a rideshare fare. Those costs are handled directly between you and the merchant or service, in this order of preference:
Best: you pay the merchant yourself in advance, by ordering online, paying by phone, or leaving a card on file at the pharmacy, and the Volunteer only collects the item.
Acceptable: you give the Volunteer a specific amount of cash, or a prepaid card loaded for the purpose, for a specific agreed purchase before they go. The Volunteer brings back every receipt and all change the same visit and records the purchase through the Service.
Not permitted: a Volunteer using their own money, using your bank card or account, or being given your PIN or account credentials.
A single agreed purchase must not exceed $100 unless OCCCS approves it in advance. Volunteers may not advance their own funds, and OCCCS does not reimburse purchases or guarantee any amount given to a Volunteer.
Donations. OCCCS is a nonprofit and accepts donations, but donating is entirely separate from OCHelpNow. Donating has no effect on whether or how quickly you receive help, and you will never be asked to donate as a condition of receiving help.
9A. Volunteer Credits
OCCCS records the hours volunteers give through OCHelpNow as credits, where one credit represents one hour. Credits are a record of participation in a community exchange. They are not money, not wages, and not a payment from you to anyone. You never pay a volunteer, with credits or otherwise.
A volunteer may give credits to another registered OCHelpNow member, including a family member or friend who has registered, as a gift. If you receive credits this way, you may use them for OCCCS activities, classes, and events that OCCCS makes available for credits, and toward receiving help through OCHelpNow.
Credits have no cash value and can never be redeemed for cash, sold, bought, or traded for money or goods. Buying or selling credits voids them. Credits are not property and are not a debt OCCCS owes anyone. OCCCS does not guarantee that any activity, class, or help will be available for credits, and may change what credits can be used for, or end the credit program, on notice.
Having no credits does not prevent you from asking for help. OCHelpNow is free, and help is not reserved for people who hold credits.
10. Communications: Calls, Text Messages, and Consent
Service-related communications. By giving us your telephone number, you agree that OCCCS and Volunteers coordinating your help may contact you at that number by phone call or text message for operational purposes — to confirm a request, coordinate arrival times, notify you of a change or cancellation, respond to your questions, or send safety notices. These are not marketing messages and are necessary to provide the Service. Text messaging is inherently less secure than other channels, and you agree to receive text messages notwithstanding that.
Fundraising and promotional communications. We will not send you fundraising or promotional text messages or automated or prerecorded calls unless you have given prior express written consent, as required by the Telephone Consumer Protection Act and applicable state law. That consent is never a condition of receiving help.
Opting out. Reply STOP to any such message, or use the unsubscribe link in any email. Opting out does not stop operational messages about help you have requested; to stop those, close your account. Message and data rates may apply.
11. User Content
The Service may let you submit content such as feedback, photographs, comments, or messages ("User Content"). You are responsible for your User Content and represent that you have the rights necessary to submit it and that it does not violate anyone’s rights.
By submitting User Content, you grant OCCCS a non-exclusive, royalty-free license to host, store, reproduce, and display it for the purpose of operating and improving the Service. We will not use your name, likeness, photograph, or personal story in marketing, fundraising, or promotional materials without your separate written permission, which you may withdraw at any time for future uses. You may ask us to remove your User Content at any time at info@occcs.org.
Feedback about a Volunteer goes to OCCCS rather than to a public profile. We use it to support volunteers and to look into concerns. Please do not include another person’s health information, address, or other personal details in User Content without their permission.
12. Intellectual Property
The Service, including its content, design, logos, trademarks, text, graphics, and software, is owned by or licensed to OCCCS and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, non-commercial purpose. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from it without our prior written consent.
13. Mobile Application and App Store Terms
If you use a mobile application, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use it on a device you own or control, in accordance with these Terms. If you obtained the application from the Apple App Store or Google Play (each, an "App Provider"): (a) these Terms are between you and OCCCS only, not the App Provider; (b) OCCCS, not the App Provider, is responsible for the application and its content, maintenance, support, and warranties; (c) the App Provider has no obligation to furnish maintenance or support; (d) if the application fails to conform to any applicable warranty, you may notify the App Provider, which may refund the purchase price, if any, and to the maximum extent permitted by law has no other warranty obligation; (e) OCCCS, not the App Provider, is responsible for addressing any third-party intellectual property claim about the application; (f) you represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited-party list; and (g) the App Providers are third-party beneficiaries of these Terms.
14. Third-Party Services
A Volunteer may coordinate with third-party services on your behalf — for example, a rideshare or taxi service, or a grocery, meal, or pharmacy service. Where you ask us or a Volunteer to do so, you authorize us and the Volunteer to communicate with that provider by phone, text, or app on your behalf in order to place, change, track, confirm, or cancel your request; to pass on your location, destination, and any access instructions you have given; and to approve substitutions where something you asked for is unavailable.
OCCCS does not provide these third-party services and does not control them. We do not inspect or verify food, groceries, or medications for safety, freshness, allergen content, or consistency with any dietary, religious, or medical requirement, and you are responsible for confirming that anything you receive is right for you. Your use of any third-party service is at your own risk and subject to that provider’s terms. Links and referrals to third-party websites and community resources are provided for convenience only and are not an endorsement.
15. Reporting Concerns, Abuse, and Exploitation
If you suspect that an older or dependent adult is being abused, neglected, or financially exploited, contact local law enforcement, call 911 in an emergency, or contact Orange County Adult Protective Services. You may also report concerns about a Volunteer or user to us at info@occcs.org.
Certain OCCCS personnel and volunteers may be mandated reporters under California Welfare and Institutions Code section 15630. Where that obligation applies, we will report suspected abuse of an elder or dependent adult to the appropriate agency as the law requires, and we may do so without your consent. We may also cooperate with law enforcement and protective agencies. OCCCS does not take responsibility for investigating, mediating, or resolving disputes between users and Volunteers.
16. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference and describes how we collect, use, share, and protect personal information.
17. Accessibility and Language Access
OCCCS serves multilingual and diverse-ability communities in Orange County. We work to make the Service accessible to people with disabilities and to make key materials available in the languages our community uses. If you need these Terms, our Privacy Policy, or help with the Service in another language or an alternative accessible format, contact info@occcs.org and we will provide it at no cost.
Where these Terms are presented to you primarily in Spanish, Chinese, Tagalog, Vietnamese, or Korean, you are entitled to a translation in that language as provided by California Civil Code section 1632, and that translation will be provided before you are asked to agree. Except where a translation is required by law to control, the English version governs in the event of a conflict.
18. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OCCCS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY VOLUNTEER, HELP, REFERRAL, OR INFORMATION OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS OR NEEDS. TO THE EXTENT ANY WARRANTY CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, IT IS LIMITED TO THE MINIMUM SCOPE AND DURATION PERMITTED BY LAW.
19. Limitation of Liability and Release of Claims
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OCCCS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, INJURY, OR HARM ARISING OUT OF OR RELATING TO (A) YOUR USE OF OR INABILITY TO USE THE SERVICE, (B) THE ACTS OR OMISSIONS OF ANY VOLUNTEER OR USER, OR (C) ANY HELP ARRANGED THROUGH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
IN NO EVENT WILL THE TOTAL AGGREGATE LIABILITY OF OCCCS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Release. OCCCS is not a party to any arrangement between Requesters and Volunteers and does not control the help they provide. Any dispute arising from such an arrangement is between you and the Volunteer or user involved. To the maximum extent permitted by law, you release and discharge OCCCS and its directors, officers, employees, and agents from all claims, demands, damages, and liabilities of every kind, known or unknown, arising out of or connected with (a) any interaction, communication, or arrangement between you and any Volunteer or user, and (b) any help performed, or not performed, by any Volunteer.
If you are a California resident, you expressly waive the protections of California Civil Code section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for gross negligence, fraud, willful injury to the person or property of another, or violation of law, and nothing limits any right you may have under California’s Elder Abuse and Dependent Adult Civil Protection Act.
20. Indemnification
Except to the extent prohibited by applicable law, you agree to indemnify, defend, and hold harmless OCCCS and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of the rights of any third party. We may, at our own expense, assume the exclusive defense and control of any matter otherwise subject to your indemnification, and you agree to cooperate.
21. Suspension and Termination
We may suspend or end your access at any time, with or without cause and with or without notice. You may stop using the Service at any time and may ask us to delete your account at info@occcs.org. Sections that by their nature should survive — including Sections 3, 11, 12, 16, and 18 through 25 — will survive.
22. Changes to the Service and to These Terms
We may review, improve, modify, suspend, or discontinue the Service or any part of it, with or without notice, and will not be liable for doing so. Where a change would materially affect help you have already scheduled, we will use reasonable efforts to tell you.
We may update these Terms from time to time. When we do, we will revise the Effective Date and, where the changes are material, give additional notice — by email to the address associated with your account, by notice within the Service, or both — before they take effect. Continued use after changes take effect means you accept the revised Terms. Prior versions are available on request.
23. Governing Law, Informal Resolution, and Disputes
Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
Informal resolution first. Before filing any claim, contact us at info@occcs.org with a brief description of the dispute and the relief you are seeking, and give us thirty days to try to resolve it. We will do the same before filing any claim against you. This is a condition to filing suit, and the applicable statute of limitations will be tolled during this period.
Venue. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts in Orange County, California. Either party may bring a qualifying individual claim in small claims court in the county where you reside.
CLASS ACTION AND JURY TRIAL WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND OCCCS EACH AGREE THAT ANY CLAIM WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND THAT EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY. THIS WAIVER DOES NOT APPLY TO ANY CLAIM FOR PUBLIC INJUNCTIVE RELIEF OR TO ANY CLAIM OR RIGHT THAT CANNOT BE WAIVED UNDER APPLICABLE LAW.
24. Force Majeure
OCCCS will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, wildfire, earthquake, flood, extreme weather, power or internet outages, public health emergencies, labor disputes, civil unrest, or acts of government.
25. Notices
We may give you notices within the Service, by email, by text message, or by mail to the contact information associated with your account, and notices given in any of these ways are effective when sent. Keep your contact information current. Notices to us must be sent to info@occcs.org or to the mailing address in Section 26.

Not for Emergencies
OCHelpNow is not an emergency service. If you or someone else is experiencing a medical emergency, a safety threat, or any situation needing immediate assistance, call 911 right away. Do not use the Service to ask for help in an emergency. Requests are not monitored continuously and may not be seen right away.
A Community Program, Not a Care Provider
OCHelpNow is a free program of Orange County Chinese Community Service. It is not a healthcare provider, home health agency, or licensed home care organization, and it does not give medical, health, legal, financial, or other professional advice. Help is limited to non-medical support. Volunteers may not provide hands-on personal care (such as bathing, toileting, dressing, feeding, or transferring), may not administer or manage medication, may not drive you anywhere, and may not handle your money, cards, or account credentials. Always consult a qualified professional for medical, legal, or financial matters.
Our Role
OCCCS connects you with community volunteers. We do not provide, supervise, direct, or control the help a volunteer gives. Volunteers are not employees, contractors, or agents of OCCCS, and they are not paid. We are not responsible or liable for the actions, conduct, qualifications, or omissions of any volunteer or user.
Screening Is Limited; No Endorsement
Volunteers apply, and once approved they must pass a background check before accepting requests. Any screening is limited in scope and is not a warranty of any person’s character, honesty, fitness, qualifications, or safety. The presence of any volunteer, resource, or third-party link on the Service is not an endorsement or guarantee.
Insurance
OCCCS does not carry automobile, general liability, workers’ compensation, or accident insurance covering volunteers, requesters, or their property. Volunteers who drive themselves to a visit are responsible for their own vehicle, license, and automobile insurance. If something goes wrong, it is a matter between the people involved and their own insurers.
The Service Is Free
OCHelpNow costs nothing. Volunteers are unpaid and must never accept money, tips, or gifts from you. You remain responsible only for the cost of goods bought on your behalf, such as groceries or a prescription copay, handled as described in Section 9 of the Terms. Donating to OCCCS is entirely separate and has no effect on the help you receive.
Personal Responsibility
Inviting someone into your home involves inherent risks. You are responsible for using your own judgment and reasonable caution, including safeguarding valuables, medications, and financial information. To the maximum extent permitted by law, you assume the risks associated with your use of the Service.
Accuracy of Information
We work to keep information on the Service accurate and current but do not warrant that it is complete, reliable, or error-free. Community resource listings and referrals are provided for convenience and may become outdated.
Limitation of Liability

Any dispute arising from help provided by a volunteer is between you and that volunteer. This does not exclude any liability that cannot be excluded under applicable law. If you suspect that an older or dependent adult is being abused, neglected, or financially exploited, contact local law enforcement, call 911 in an emergency, or contact Orange County Adult Protective Services. You may also report concerns to us at info@occcs.org or 949-636-9906.
